Welcome to 48HourWebsites ("Company," "we," "our," or "us"). By purchasing or using our website design services, you ("Client," "you," or "your") agree to the following Terms & Conditions.
1. Scope of Services
48HourWebsites provides fast website design services, including but not limited to:
- Website design and development
- Website redesign
- Mobile-responsive layouts
- Basic SEO structure
- Hosting setup and SSL (if included in plan)
All services are delivered based on the package selected at the time of purchase.
2. Order Submission & Project Start
To begin any project, the Client must:
- Complete the onboarding intake form in full
- Provide all required materials (text, images, logo, business info, etc.)
- Submit accurate and complete information
⚠️ Important: The build timeline DOES NOT begin until:
- The intake form is fully completed
- All required assets are received
- The project is reviewed and approved by our team to start
If information is incomplete or unclear, the project timeline will be delayed accordingly.
3. Delivery Timeline Policy
Delivery times vary by plan, measured from the moment of project approval:
- Starter Plan (1–2 pages): 48 hours
- Growth Plan (3–5 pages): 72 hours
- Full Site Plan (6–12 pages): 96 hours
48HourWebsites aims to deliver completed websites within the plan's delivery window after project approval. This timeline applies only when:
- All required materials are submitted correctly
- No additional custom requests are made beyond the package scope
- Client responds promptly if clarification is needed
4. Client Responsibilities
The Client agrees to:
- Provide accurate and complete information
- Respond to requests for clarification in a timely manner
- Review the website promptly upon delivery
- Ensure all content provided does not violate any laws or third-party rights
Delays caused by the Client may extend the delivery timeline.
5. Revisions Policy
- Unlimited revisions are included for 7 days after initial delivery
- Revisions must fall within the original project scope
- Major redesigns or additional pages may incur additional fees
6. Ownership & Intellectual Property
Upon full payment:
- The Client owns the website design and content
- The Client has full rights to use, modify, or transfer the website
However:
- Third-party tools, themes, or platforms remain subject to their respective licenses
- 48HourWebsites retains the right to showcase the project in its portfolio unless otherwise agreed
7. Hosting & Platform
If hosting is included:
- Hosting and SSL are provided for the duration specified in the package
- Renewal fees may apply after the initial term
We use a third-party website platform, and availability or performance may depend on that provider.
8. Limitations of Service
48HourWebsites is not responsible for delays or failure to deliver services caused by factors outside our control, including but not limited to:
- Power outages
- Internet outages
- Natural disasters (floods, fires, earthquakes, tornadoes, etc.)
- Server or platform downtime
- Third-party service interruptions
- Government actions or emergencies
These events may extend delivery timelines without penalty.
9. Refund Policy
Standard Policy: Due to the nature of digital services, all sales are generally non-refundable once work has begun.
Delivery Guarantee (Partial Refund Clause): If 48HourWebsites fails to deliver the website within the plan's guaranteed delivery window (excluding delays caused by the Client or force majeure events), the Client may be eligible for a partial refund as follows:
- 10% refund for delays up to 24 hours beyond the plan deadline
- 20% refund for delays beyond 48 hours past the plan deadline
- Maximum refund capped at 30% of total project cost
Guaranteed delivery windows by plan (from intake approval):
- Starter Plan: 48 hours
- Growth Plan: 72 hours
- Full Site Plan: 96 hours
Conditions:
- Client must have submitted all materials on time
- No scope changes or additional requests were made
- Delay must be solely attributable to 48HourWebsites
Refund requests must be submitted within 7 days of delivery.
10. Cancellations
- Orders may be canceled before work begins for a full refund
- Once the project has started, cancellation may result in partial or no refund depending on work completed
11. Limitation of Liability
To the fullest extent permitted by law, 48HourWebsites shall not be liable for:
- Loss of business, revenue, or profits
- Website downtime after delivery
- SEO rankings or performance guarantees
- Third-party service failures
Our total liability shall not exceed the amount paid for the service.
12. Indemnification
The Client agrees to indemnify and hold harmless 48HourWebsites from any claims arising from:
- Content provided by the Client
- Copyright or trademark violations
- Misuse of the website
13. Modifications to Terms
We reserve the right to update these Terms at any time. Continued use of our services constitutes acceptance of updated terms.
14. Governing Law
These Terms shall be governed by the laws of the State of California.
